What Ohio employers may do
Ohio law sides with employers on marijuana. Under ORC 3796.28, which covers medical use as well as adult use, an employer does not have to accommodate it and may:
- refuse to hire you for marijuana use;
- fire or discipline you for use, possession or distribution;
- keep drug-testing, drug-free workplace and zero-tolerance policies.
You cannot sue over those actions. If you are fired for use that breaks a workplace policy, it counts as just cause for unemployment, which can cost you benefits. The DCC's own FAQ answers the question "Can my employer fire me for using marijuana?" with "Yes."
Lorain itself is in Lorain County on the Lake Erie shore; the county seat is Elyria. None of this varies by county. It is state law.
Before you register: four questions for yourself
- Does my employer test? Pre-hire, random, after an accident, on suspicion?
- What does the written policy say? Find the handbook language, not what a coworker remembers.
- Would a positive result end my job? Some policies say so outright.
- Have I talked to my physician about it? If cannabis is off the table at work, your physician can talk through other options for your condition.
Our Ohio employment page walks through the statute in more detail.
Need the recommendation part done?
In Ohio the physician starts your Registry file, so the visit comes first. Online evaluations are available for Ohio residents, and code DRWDY85872 takes 5% off. Registration itself is free.
Start my Ohio evaluation →What the card still does
A card does not shield your job, but it is not useless either. Medical purchases skip the 10% adult-use excise, patients can buy four days' worth at once and hold up to a 90-day supply, and patients under 21 have no other legal route. Outside work, ORC 3796.24 bars using lawful medical use as the sole or primary basis for a custody decision or asset forfeiture.
And whatever your job, never use at work or before driving. Workplaces are on the list of places where smoking and vaping marijuana are banned, and the DCC says you cannot drive after using cannabis.
Getting the card in Lorain County
The steps are the same statewide. A physician with a Certificate to Recommend from the State Medical Board examines you, in person or by video, and enters your recommendation. You activate it in the Registry for $0. The application checklist lists the ID and residency documents.
For a store, use the DCC's official dispensary map. Every licensed location is dual-use.
Along the lakeshore
East toward Cleveland, the Parma guide covers home grow and the Cleveland guide covers renting with a card. West, the Toledo guide explains SB 56's hemp change.
Your move
Get your employer's drug policy in writing first. If it leaves room, register. If it does not, talk to your physician before you decide.
Questions people ask
Can I be fired in Ohio for testing positive if I have a card?
Yes. ORC 3796.28 lets employers fire or discipline for marijuana use, medical included, and enforce drug-testing and zero-tolerance policies.
Can I get unemployment after being fired for marijuana use?
If the firing was for use that violated a workplace policy, Ohio law treats it as just cause for unemployment purposes.
